Restaurant Says Cookie Seller Infringes ‘Frickin’’ Trademarks

Midwest restaurant chain Fricker’s accused Michigan-based “Frick’n Good Cookies” of infringing its array of registered “Frickin” trademarks in a complaint in Michigan federal court.

Fricker’s Progressive Concepts Inc., which is based in Ohio and operates as Fricker’s, said consumers would wrongly think it was affiliated with cookies sold by Frick Investments LLC, the complaint in the US District Court for the Eastern District of Michigan said. The “Good Cookies” portion of the trademark Frick’n Good Cookies seeks to register is descriptive, so “Frick’n” is the dominant element and also emphasized in the cookie company’s branding, Fricker’s said.
