It is necessary to focus on the main theoretical assumptions that underlie the Declaration of Human Rights, specially on those that are at present under controversial discussion in the field of philosophy. In this paper, the author, according to the ideas of the different international declarations on humans rights, sustains that human rights are not only a positive juridical instrument, but also, and mainly, a high human achievement based on the discovery and recognition of the dignity and worth inherent in the human person. Human Rights is the result of a very long tradition of people who have fight in favor of human beings, in alí the societies and in every moment of human history; they exist just because people fxght for them and ask for their 11111 recognition. They are universal , and every government in the world have to protect them and promote a fuller observance of those rights. Human person is te central subject of human rights; it is very confusing to speak of animals' rights. The right of people to self-determination, as a part of human rights, applies only in the particular situations of people under colonial or other forms of alien domination of foreign occupation. Human rights also imply a high level of duties and virtues, and the recognition that humans beings are mcm-bers of a community that make possible to be a human person. Although they focus on the social and political dimensions of human life, they are looking also for the happiness ofpeople, as long as they promote peace, democracy, justice, equality, rule of law, pluralism, development, better standards of living and solidarity. En este artículo se comentan las tesis que presenta Alan Arias en “Tesis sobre una teoría crítica de los Derechos Humanos”. En primer lugar se contextualizan tales tesis sobre el fondo de la idea de “lucha igualitaria” de Marx. En la segunda parte se exploran los elementos socioculturales en los Derechos Humanos, dentro de los que son destacados, principalmente: 1) los comportamientos culturales basados en perspectivas clasistas, racistas e individualistas 2) el papel de los intelectuales y los héroes y 3) las instituciones de transmisión cultural.
