Her sudden death following knee surgery shocked fans of cult comedy Road Trip.

Now the widower of Mia Amber Davis, who played gargantuan geek lover Rhonda in the hit movie, is suing her doctors over what he believes was the irresponsible prescription of birth control pills.

Mike Yard believes the decision to give the plus size model the drugs just months before her surgery contributed to her death of a blood clot in her lungs last May.

According to TMZ, he is arguing in court documents she was too obese to be on the pills prescribed by her gynecologist, which included Balziva and Zenchent.

She died just one day after her knee surgery, and the death was later discovered to have been caused by a pulmonary embolism.

And the filed documents argue they are 'drugs that greatly increase one's risk' of a lung artery blockage, 'especially when combined with [Mia's] other risk factors.'

Mr Yard lists 'obesity' as one of the star's other significant risk factors.

The comedian goes on to argue that condoms or other methods of birth control should have been suggested instead.

He goes on to claim that when she went to a family practitioner on April 18 to complain about knee pain she was cleared for knee surgery despite a number of risk factors.

These included obesity, high blood cholestorol levels and the fact she was on Zenchent.

He claims the doctor 'should have advised [Mia] to eliminate some of her other risk factors prior to clearing her for the surgery.'

She went on to have surgery, which she hoped would help cure an old basketball injury, on May 9 and died the next day.

He is suing both the gynecologist and the family practitioner for unspecified damages.

He is looking for monetary compensation for the loss of love, companionship and moral support he suffered as a result of Mia's death.
