From 1 July 2024, Victoria will be replacing stamp duty on commercial and industrial property, with a new annual commercial and industrial property tax (CIPT). In our April edition of Legal Knowledge Matters we bring you a New South Wales article about a complying development certificate issued by a private certifier in circumstances where the relevant site was listed as a draft heritage item is declared invalid. We also bring you a Victorian article regarding an application for the determination of an alleged disputed claim in respect of the compulsory acquisition of land is struck out because the claim was not a "disputed claim" under the Land Acquisition and Compensation Act 1986 (Vic) when the application was made.   Finally, we bring you four Queensland articles on the following topics: an appeal against the refusal of a local law permit for short stay letting of a unit at Noosa is dismissed, an appeal by a submitter seeking the refusal of a development approval for a development permit for a material change of use for a three-storey multiple dwelling on the Gold Coast because of shadowing is dismissed, an application seeking to change a development application relating to a mixed-use development is dismissed because of a lack of evidence in support of the change being a "minor change", and an appeal against the refusal of an application for the extension of the currency period of a development permit for a rural subdivision is dismissed because of the lack of evidence justifying the delay in carrying out the development.   Legal Knowledge Matters is the monthly publication of the Planning Government Infrastructure and Environment group at Colin Biggers & Paisley.
