There are some material omissions, inaccuracies and misstatements in the recently released annual international Investment Climate Statement by the U.S. Department of State. 1. Uganda has some sector-specific competition regulations e.g communications. A Competition Act is in the offing awaiting Presidential assent. 2. Court mediation is nolonger mandatory. Arbitration is contractual. Parties can proceed straight to litigation if their contracts do not have binding arbitration clauses. 3. Outward investment is promoted via Bilateral Investment Treaties, that stipulate reciprocal obligations of investments from the respective treaty states. The main challenge is that Uganda is mostly a recipient of inward-bound FDI. There are tax incentives on select Ugandan exports. 4. The List of SOEs is known as they are mostly creatures of statute, receive appropriation from Parliament under their respective public sector finance votes and are audited annually by the Auditor General. All these processes generate reports that can be publicly accessed from ministry websites and Parliament. #FDI #Uganda #business #trade #geopolitics
