Abstract :

El autor abordó la institución de la condena del absuelto, la cual otorga a la Sala Penal de Apelaciones, la facultad de condenar al imputado que fue absuelto en primera instancia. Por ello, se planteó el siguiente problema: ¿En qué medida, en el Perú, condenar en segunda instancia al acusado absuelto, implica la violación de su derecho a un recurso amplio e integral, reconocido en el precedente jurisprudencial emitido por la Corte Interamericana de Derechos Humanos en el caso Óscar Alberto Mohamed vs. Argentina?; siendo que se determinó, que la facultad de la Sala Penal de Apelaciones de condenar al absuelto, vulnera en gran medida, el derecho al recurso amplio e integral, desarrollado en la jurisprudencia emitida por la Corte Interamericana de Derechos Humanos. Para la recolección de información se utilizaron técnicas e instrumentos tales como: La recopilación documental y el fichaje, la misma que fue presentada en Tablas y Figuras, siendo analizada y discutida, utilizando la hermenéutica jurídica. Los resultados encontrados verificaron la hipótesis de trabajo, determinándose que la facultad de la Sala de Apelaciones de condenar al absuelto, contradice la jurisprudencia emitida por la Corte Interamericana de Derechos Humanos, vulnerándose el derecho al recurso. The present investigation was about the institution of the conviction of the absolved person, which gives the Criminal Appeals Chamber the faculty to convict the accused who was acquitted at first instance. For this reason, the following problem was raised: To what extent, in Peru, to convict on second instance the accused who was absolved, implies the violation of his right to a comprehensive and an integral recourse, recognized in the jurisprudential precedent issued by the Inter-American Court of Human Rights in the case Óscar Alberto Mohamed vs. Argentina?; being that it was determined that the power of the Criminal Appeals Chamber to convict the absolved person violates, to a large extent, the right to a comprehensive and an integral resource, developed in the jurisprudence issued by the Inter-American Court of Human Rights. For the collection of information, techniques and instruments were used such as: The documentary collection and the signing, the same that was presented in Tables and Figures, being analyzed and discussed, using legal hermeneutics. The results found verified the hypothesis of the investigation, determining that the faculty of the Appeals Chamber to condemn the absolved person, contradicts the jurisprudence issued by the Inter-American Court of Human Rights, violating the right to appeal.
