Bundan üç yıl önce, Türk futbolunun kalbine bir hançer saplandı.

Fenerbahçe Spor Kulübü Başkanı ve yöneticilerine yönelik şike iddialarına ilişkin bir operasyon başlatıldı.  

Soruşturma ve kovuşturma sürecinde temel hukuk prensiplerine aykırı tutum sergilendi.

Bu yetmezmiş gibi özel hayatın gizliliği ve masumiyet karinesi ihlal edildi ve daha ilk günden kamu algısında Fenerbahçe yöneticileri haksız yere, -yargılaması dahi başlamadan- suçlu ilan edildi.

Üzerinden iki buçuk yıl geçmesine rağmen sarı-lacivertliler aynı kararlıkla hak arama mücadelesine devam ederken, bu mücadele artık tüm kesimlerin kabullendiği ve sahip çıktığı bir çığlığa dönüştü.


Bugün, güncel gelişmeler ışığında "Özel Yetkili Mahkemeler tarafından görülen davaların yeniden yargılama kapsamına girebileceği" gündeme geldi ve hatta iktidar tarafından da bu mahkemelerin meşruiyeti tartışmaya açıldı.


Sözde Şike davasında olduğu gibi diğer davalarda da birçok hukuksuzluğa imza atan Özel Yetkili Mahkemelerin kapatılmasına rağmen verdikleri kararların hala uygulamada olması sizce de yanlış değil mi?

Fenerbahçe Spor Kulübü; yüzbinlerin yürüyüşünde yüksek sesle haykıran binlerce kadın, çocuk, genç, yaşlı herkesin vicdanında aklandı.

Şimdi, talebimiz bir ayrıcalık beklemeksizin, tek bir gün daha kaybetmeksizin Fenerbahçe Spor Kulübü Başkanı Aziz Yıldırım ve yöneticilerinin adilce ve yeniden yargılanması.

Bu hukuki mücadele, hangi takımdan olursa olsun, hangi fikri savunursa savunsun artık halkın mücadelesi!

Three years ago, a dagger pierced the heart of Turkish football.

An operation was unleashed against the President and management of Fenerbahçe Sports Club on allegation of match-fixing, and a position going against basic legal principles was exhibited in the inquiry and subsequent proceedings.

As if this wasn’t enough, the right of privacy and the principle of the presumption of innocence were violated, and from the very first day the senior management of Fenerbahçe was unjustly pronounced guilty to the public, even before trial proceedings had started.

Despite the fact that two-and-a-half years have elapsed, the yellow-and-blues continue to pursue their right to legal remedy with the same determination while the struggle has as the same time become a cause which all segments of society have taken on and have turned into a call for justice.

Today, the possibility that “the lawsuits heard in the Specially Authorized Courts may be reassessed at a retrial” has become an item on the agenda in the light of recent events and even the ruling government has brought the legitimacy of these courts up for discussion.

Just as they did in the lawsuit on alleged match-fixing, the Specially Authorized Courts have also issued many unlawful ruling in other lawsuits. Despite these courts now having been closed, do you think it is wrong that the decisions of these courts should still be in force?

Fenerbahçe Sports Club has been declared innocent in the conscience of the public by the women and children, the young and old who all screamed out their support for the club as they marched in their hundreds of thousands in protests.

At this point in time, we demand a fair retrial for both the President of Fenerbahçe Sports Club, Aziz Yıldırım, and the club’s management without prejudice and without a single day’s delay.

This legal battle is now the battle of the people, no matter which sports club they belong to, no matter what views they defend!

In short, now is the time for “Justice for Turkey, Justice for Fenerbahçe.”

Not tomorrow, but today, before it’s too late… Right now…
